1. Who We Are

SongUp AI (songupai.com) is operated by Ismail Farooq, a sole proprietor based in Lahore, Punjab, Pakistan, trading as SongUp AI at songupai.com (“SongUp AI”, “we”, “us”). Ismail Farooq is the legal name of the business.

SongUp AI makes original songs with AI: you describe a song or write lyrics, choose a genre and language, and get a new track. It also offers browser tools for working with audio you own, such as the Stem Separator and Audio to MIDI. By creating an account or using the site you agree to these terms.

2. Prohibited Uses

You may not use SongUp AI for any of the following. Breaking these rules ends your account immediately, without a refund:

Sexual and adult content: creating, uploading or sharing sexually explicit, pornographic or adult (NSFW) content of any kind, including songs, lyrics, titles, cover art, images, videos or any other media. Any sexual content involving minors is banned absolutely and is reported to the authorities.
Impersonating real people: content that imitates or falsely represents a real artist, musician, public figure or any other person, including songs made to sound as if someone else made or sang them. SongUp AI does not offer voice cloning, and you may not upload or use another person's voice or likeness.
Infringing other people's rights: reproducing copyrighted songs, melodies or lyrics, sampling recordings you have not cleared, or recreating trademarked sounds.
Harmful or deceptive content: hate speech, harassment, threats, defamation, fraud, or content meant to mislead people about who made it or what it is.

Prompts that name real artists or well-known songs can be rejected. We remove content that breaks these rules, suspend the accounts involved, and cooperate with rights holders and law enforcement.

3. Commercial Licensing & IP Ownership

Your rights to the songs you make depend on your plan at the time you make them.

Free Tier Non-Commercial

The introductory free songs (3 songs' worth of free credits) given at signup are for song creation only and cannot be used for custom lyric generation.

Songs made on the Free tier are for personal, non-commercial use. Monetising them (for example on Spotify, YouTube Content ID or in commercial broadcast) breaks these terms. Public use requires credit to SongUp AI.

Paid Plans: Lite, Pro, Pro Plus, Elite & Ultra Full Commercial

Upon generation, SongUp AI assigns you full copyright ownership and commercial monetization rights. You may distribute, license, loop, and broadcast these generations globally without royalty obligations to SongUp AI, provided your subscription was active and in good standing at creation. The same applies to a song bought on its own (a one-time purchase). Each such song can be downloaded with a certificate of ownership, which anyone can check at songupai.com/verify.

The Instant Match library. Songs delivered on the Free tier are matched from a shared library of finished tracks rather than composed for you. By generating a song on a free account you grant SongUp AI a non-exclusive, worldwide, royalty-free licence to add that recording to that library and serve it to other users as an Instant Match. Only the audio is reused: your prompt, your lyrics, your title and your account are never shown to anyone else, and a song whose prompt names a person is never added. This licence applies to free generations only — songs created on a paid plan are yours and are never added to the library. Ask us at any time and we will remove your track from it.

4. Audio You Upload

Some tools work with audio you upload or record: Hum to Song uses the melody you hum, and tools such as the Stem Separator, Audio to MIDI and Neural Auto-Tune process files you provide. Upload only audio you own or have the right to use. You keep ownership of what you upload, and you are responsible for any rights in it.

5. Credits, Payments & Refunds

Credits: making a song uses credits from your plan. Each renewal adds your plan's credits to what you have left, so unused credits roll over while your subscription is active. Song packs you buy never expire. Credits already refunded, or taken back after a dispute, leave your account.
Failed songs: if a song doesn't finish or the file is broken, its credits go back to your account. AI results vary, so not liking a song is not a technical failure, but our Refund Policy still refunds every song you haven't made when you ask within 14 days of paying, and the team answers every later request: you pay only for the songs you make.
Payments: processed by our reseller and Merchant of Record, whose name is on your receipt and bank statement, which handles payment, invoicing and sales tax/VAT. You can cancel any time from the Billing page: no further charges are taken and your plan stays active until the end of the period you paid for.

6. Limitation of Liability

The service is provided “as is”. We do not promise it is fit for any particular commercial purpose. Our total liability to you is limited to the amount you paid SongUp AI in the twelve (12) months before the claim. Nothing here limits rights consumer law gives you where you live.

7. Changes to These Terms

We may update these terms and will change the date at the top when we do. Our Community Guidelines and Privacy Policy form part of them.

Pro offer terms: first month for $1

Who can claim it: free accounts that have never had a SongUp AI subscription. One offer per person; accounts sharing a device, network or email with a past subscriber are not eligible. It is a limited-time promotion and can end or change at any time.
What the first month includes: 5 songs composed by SongUp AI from your own prompts or lyrics, with the Pro commercial license.
After the first month: Pro renews automatically at $9.99/month (or the local price shown at checkout), with 21 songs every month. Cancel any time before the renewal date and you will not be charged again; Pro stays active until the end of the month you paid for. We email you 3 days before the renewal date, with a link that stops it.
Releasing and earning: songs made while your plan is active carry the commercial license in Section 3, so you can release them on Spotify, Apple Music, YouTube and other platforms through a distributor of your choice and keep your earnings. Streaming income depends on those platforms and your distributor, and SongUp AI does not guarantee any amount. Songs from the free Instant Match library are not included.
Payments: handled by our Merchant of Record, whose name is on your receipt; taxes may be added at checkout.
